Traveler Terms and Conditions

 

Welcome to our vacation rental property listed on SummitCottage.ca! We are glad you have chosen to stay with us, and we hope you have a wonderful and enjoyable experience.

 

By making a booking with us, you agree to the following Terms and Conditions:

 

Booking and Payment

1.1 Booking: You can book our property by filling out our online booking form on our website. By submitting the form, you are making a reservation request, which is subject to availability and our approval. We reserve the right to accept or reject any booking request in our sole discretion.

 

1.2 Payment: The total booking amount and payment terms may vary based on the specifics of your reservation, such as the length of your stay and the chosen payment method. The payment terms will be automatically determined by our system at the time of booking and will be outlined in your reservation details. In some cases, we may require payment in full at the time of booking. In other cases, we may allow for multiple payment installments, with the remaining balance due at designated intervals prior to your arrival date. The payment details will be clearly communicated to you during the booking process. Failure to make payment in accordance with the payment terms may result in the cancellation of your booking and forfeiture of your deposit.

 

Cancellation and Refunds

2.1 Cancellation by you: If you need to cancel your booking, please notify us as soon as possible. Depending on the timing of your cancellation, you may be entitled to a partial or full refund of the amount they've paid. Travelers who cancel at least 60 days before check-in will get back 100% of the amount they've paid. If they cancel between 30 and 60 days before check-in, they'll get back 50%. Otherwise, they won't get a refund.

 

2.2 Cancellation by us: In the unlikely event that we need to cancel your booking, we will notify you as soon as possible and provide you with a full refund of any payments made.

 

Check-in and Check-out

3.1 Check-in: Our standard check-in time is 3PM on your arrival date. Please let us know if you plan to arrive outside of this time so we can make arrangements to accommodate you.

 

3.2 Check-out: Our standard check-out time is 10AM on your departure date. Late check-out may be available upon request and subject to availability.

 

Property Use and Occupancy

4.1 Property use: You agree to use our property for vacation purposes only and in accordance with all applicable laws and regulations. You agree not to use our property for any unlawful or commercial purposes, including but not limited to parties, events, or gatherings without our prior written consent.

 

4.2 Occupancy: The maximum number of guests allowed in our property is 8. You agree to disclose the total number of guests in your party at the time of booking. We reserve the right to refuse or revoke access to our property to any person who exceeds the maximum occupancy or engages in any unlawful or disruptive behavior.

 

Property Condition and Damage

5.1 Property condition: You agree to maintain our property in a clean and tidy condition during your stay and to leave it in the same condition as when you arrived. You agree to report any damages or malfunctions to us as soon as possible.

 

5.2 Damage: You agree to pay for any damages caused by you or your guests during your stay, including but not limited to broken or missing items, excessive cleaning required, or any other damage that exceeds normal wear and tear. We reserve the right to charge your credit card on file for any such damages.

 

Liability and Insurance

6.1 Liability: We assume no liability for any loss, damage, injury, or illness that may occur to you or your guests during your stay, including but not limited to theft, fire, natural disaster, or accidents. You agree to indemnify and hold us harmless from any such claims.

 

6.2 Insurance: We strongly recommend that you purchase travel insurance to protect yourself and your guests against unforeseen circumstances that may affect your travel plans or cause you to cancel your booking.

 

Governing Law and Dispute Resolution

7.1 Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the province of Ontario where the vacation rental property is located, without giving effect to any principles of conflicts of law.  and any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

 

7.2 Dispute Resolution: If you have any issues or disputes regarding your booking or stay, please contact us as soon as possible so we can try to resolve the issue. If we are unable to resolve the issue, you agree to submit to arbitration in accordance with the rules of Small Claims Court, Superior Court of Justice before resorting to any other legal action.

 

Miscellaneous

8.1 Entire Agreement: These Terms and Conditions constitute the entire agreement between you and us and supersede all prior understandings, agreements, or representations.

 

8.2 Amendments: We reserve the right to amend these Terms and Conditions at any time and without prior notice to you. The updated Terms and Conditions will be posted on our website, and you are responsible for reviewing them periodically.

 

8.3 Severability: If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

 

By making a booking with us, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, and that you are legally bound by them.
